BETA TESTING DISCLAIMER
These Terms apply to the beta version of the Transient Intelligence web application and API (the "Service"). As a beta product, the Service is still under development and testing, and may contain bugs, errors, or incomplete features. This document is preliminary and may be updated as we refine the Service based on beta tester feedback and further legal review. By using the Service, you acknowledge you are using pre-release software. Feedback on these Terms can be sent to support@transientintelligence.com.

Introduction
This Terms of Service agreement ("Agreement") is between Transient Intelligence LTD ("Company," "we," "us," or "our") and the individual or entity using the Service ("you," "your"). This Agreement governs your access to and use of the Service.

1. Beta Purpose
The purpose of this beta program is to evaluate the Service's functionality, usability, performance, and reliability before public release. You may encounter errors or downtime, and features may change without notice.

2. Eligibility Requirements
By accepting this Agreement, you confirm that:

2.1. You are at least 18 years of age and have the legal capacity to enter into this Agreement.

2.2. You will use the Service in accordance with applicable laws and regulations.

2.3. You have the rights and permissions necessary to upload and process any documents, data, or content you provide to the Service.

3. Beta Period
3.1. The beta period begins upon your acceptance of this Agreement and continues until terminated by either party.

3.2. We may suspend or terminate the beta program (or your access) at any time, including without notice, for operational, security, or legal reasons.

3.3. You may stop using the Service at any time.

4. Your Responsibilities
You agree to:

4.1. Use the Service only for lawful purposes and in accordance with these Terms.

4.2. Provide honest, constructive feedback about the Service’s performance, features, and usability when requested.

4.3. Report bugs, errors, security issues, or other problems promptly through the designated support channels.

4.4. Maintain the confidentiality of your login credentials and not share your account with unauthorised users.

4.5. Not upload content you are not authorised to process, including content that violates privacy, confidentiality, or third-party rights.

4.6. Not use the Service to create, store, or distribute illegal content, malware, or content intended to harm others.

4.7. Not attempt to interfere with, disrupt, or gain unauthorised access to the Service (including by probing, scanning, scraping, bypassing rate limits, or circumventing security measures).

4.8. Not use the Service or its outputs for unlawful, harmful, or abusive purposes, including fraud, harassment, defamation, or infringement of third-party rights.

4.9. Not reverse engineer, decompile, or attempt to extract source code, models, prompts, or underlying system details except to the extent permitted by law.

5. AI Output Limitations and Disclaimers
5.1. BETA STATUS: The Service is provided "AS IS" and "AS AVAILABLE" during beta, without warranties of any kind, whether express or implied.

5.2. NO PROFESSIONAL ADVICE: The Service is not a professional advice tool (legal, medical, financial, or otherwise). Outputs are informational only.

5.3. AI LIMITATIONS: The Service may produce outputs that are incomplete, inaccurate, or misleading. You are responsible for verifying outputs and determining whether they are suitable for your use case.

5.4. NO GUARANTEE OF RESULTS: We do not guarantee that the Service will identify all relevant information in your documents or produce any specific outcomes.

5.5. MISUSE OF OUTPUTS: You are responsible for how you use the Service and any outputs. We are not responsible for any decisions, actions, or outcomes resulting from your use of outputs, including where outputs are inaccurate or incomplete.

5.6. INDEMNITY: You agree to indemnify and hold harmless the Company from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your documents/content, (b) your use of the Service or outputs, or (c) your breach of this Agreement.

6. Confidentiality (Beta)
6.1. The Service, including unreleased features, performance characteristics, and non-public documentation, may be considered confidential information.

6.2. You agree not to disclose non-public details of the beta Service to third parties in a way that harms our business interests, security, or the integrity of the beta program.

6.3. Nothing in this section restricts you from discussing general impressions, sharing non-sensitive screenshots for support/debugging, or complying with legal obligations.

7. Intellectual Property
7.1. All intellectual property rights in the Service (excluding your documents and content) remain the exclusive property of the Company or its licensors.

7.2. You are granted a limited, non-exclusive, non-transferable license to use the Service during the beta period for its intended purpose.

7.3. Any feedback, suggestions, or ideas you provide may be used by us without obligation to compensate you.

8. Data Protection
8.1. Personal data processed by the Service will be handled in accordance with our Privacy Policy and applicable data protection laws.

8.2. You are responsible for ensuring you have a lawful basis to upload and process documents, including if they contain personal data or special category data.

8.3. If you believe your data has been mishandled or you suspect a security incident, notify us at support@transientintelligence.com.

9. Payments and Credits (If Applicable)
9.1. Some features may require payment or credits. Pricing, credits, and billing terms may be updated during beta.

9.2. Payments are processed by third-party providers (e.g., Stripe). We do not store full card details.

9.3. Credits expire 12 months from the date of purchase (or allocation), unless otherwise stated. During beta, expiry enforcement may not be active immediately, but may be introduced later.

9.4. Credits have no cash value, are non-transferable, and are non-refundable except where required by law or in cases of service failure or non-delivery of credits.

10. Termination
10.1. Either party may terminate this Agreement at any time.

10.2. Upon termination, you must cease use of the Service. Where applicable, you may request deletion of your account data in accordance with the Privacy Policy.

10.3. Sections 5, 6, 7, 11, and 12 survive termination of this Agreement.

11. Limitation of Liability (Important)
11.1. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, business opportunity, data, or anticipated savings, arising out of or in connection with your use of the Service.

11.2. To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with this Agreement and/or the Service (whether in contract, tort (including negligence), breach of statutory duty, or otherwise) will not exceed the total fees paid by you for the Service in the 12 months immediately preceding the event giving rise to the claim.

11.3. Nothing in this Agreement limits or excludes liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded under applicable law.

12. General Provisions
12.1. This Agreement is governed by the laws of England and Wales.

12.2. Any disputes arising from this Agreement shall be resolved in the courts of England and Wales.

12.3. This Agreement constitutes the entire understanding between the parties regarding the beta Service.

12.4. If any provision of this Agreement is found to be unenforceable, the remaining provisions remain in full force and effect.

13. Acceptance
By clicking "I Accept" (where presented) or by using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

User Acknowledgment (Optional)
- I understand the Service is in beta testing and may be unreliable.
- I understand AI-generated outputs may be inaccurate and require review.
- I confirm I have permission to upload and process any documents I submit.
